The Federal Court condemned the youtuber Bruno Aiub, known as Monarchto one year and two months in prison for the crime of injury against the minister of the Federal Supreme Court Flavio Dino.
The sentence, handed down on October 2 by judge Maria Isabel do Prado, of the 5th Federal Court of São Paulo, also imposes the payment of compensation of 50 thousand reais. The sentence, for now, must be served in a semi-open regime, and Monark will be able to appeal in freedom.
The case occurred in June 2023, when, during a podcast, Monark made offensive comments to the minister, calling him “fat” and “son of a bitch”.
Dino, then Minister of Justice, filed a criminal complaint for slander, defamation and insult. In one of the excerpts that supported the action, Monark stated: “You are going to be enslaved by a big fat guy (…) Are you going to let this guy be your master? Is that what your parents educated you for?”
In the decision, the judge dismissed the conviction for defamation, but recognized the crime of insult, considering that the expressions used by Monark went beyond the right to criticism. “It is unequivocal that the sentences he spoke were offensive to the dignity and decorum of the victim”, stated the judge, highlighting that the influencer “exceeded the spirit of mere criticism”.
Prado also highlighted that Monark’s insults, such as “this piece of shit” and “a piece of shit”, have an scatological content and seriously insult the minister’s dignity. She stressed that the right to criticism does not justify “indiscriminate, frivolous and demeaning insults and accusations”.
Monark did not hire lawyers and was represented by the Public Defender’s Office, which unsuccessfully requested the criminal proceedings be suspended.
